President Cyril Ramaphosa has authorized the immediate and full implementation of the Basic Education Laws Amendment (BELA) Act, a significant legislative development in South Africa's education sector. The BELA Act introduces several key changes to the South African Schools Act (SASA), notably: Admission Policies: School governing bodies are now required to submit their admission policies to the Head of Department for approval.

This measure aims to standardize admission procedures across public schools, ensuring equitable access for all students. Language Policies: Similarly, governing bodies must submit their language policies for departmental approval. This provision seeks to promote inclusivity and accommodate the country's linguistic diversity within the education system. The Act also addresses the admission age for Grade R, allowing parents to enroll children at a younger age under certain conditions, with priority given to learners of compulsory school-going age when capacity is limited.

President Ramaphosa initially signed the BELA Act into law in September 2024 but delayed the implementation of clauses 4 and 5 to allow for further consultation. These clauses pertain to the approval processes for admission and language policies. After thorough deliberation, the President has now instructed Basic Education Minister Siviwe Gwarube to proceed with the full implementation of the Act. The decision has elicited mixed reactions. The Democratic Alliance (DA) expressed opposition to clauses 4 and 5, describing them as "unnecessary" and alleging they target Afrikaans language schools. Despite this, the DA has indicated satisfaction with the overall implementation of the Act.

Minister Gwarube has been tasked with ensuring that the education system is prepared for the Act's implementation, particularly concerning universal Grade R access. This includes developing regulations that set out norms and standards to guide the process. All officials involved are expected to act in accordance with the Constitution, relevant laws, and policies during the implementation phase.
